The court, however, ruled that the Monday’s order is effective until June 11 this year, when the substantive motion would be heard.

On importance of maintaining the rule of law in Kano State

Justice Aliyu also stressed the importance of maintaining the rule of law in the Northern state.

“This court will ensure that its orders are respected and upheld until the substantive motion is heard,” his Lordship stated.

It is also noted that the Monday court order also affects four other traditional rulers in the dissolved Emirates.

The order yet restrains Nasiru Ado Bayero, Ibrahim Abubakar II, Kabiru Muhammad Inuwa and Aliyu Ibrahim Gaya from parading themselves as Emirs of Bichi, Gaya, Rano and Karaye Emirates respectively.

The defendants in this suit include Ado Bayero, Ibrahim Abubakar II,  Kabiru Muhammad Inuwa, Aliyu Ibrahim Gaya, the Inspector-General of Police (IGP), Director of the Department of State Services (DSS), Nigeria Security and Civil Defence Corps (NSCDC), and the Nigerian Army (NA).

The plaintiffs are the Attorney-General of Kano State, the Speaker of the Kano State House of Assembly, and the Kano State House of Assembly.

Amid the confusing atmosphere laced with uncertainty in Kano, a Federal High Court earlier had ruled last Thursday against the reinstatement of Muhammadu Sanusi II as Emir of Kano, and also suspended the law establishing the dissolved five emirates in the state.

Commenting on the development, Governor Abba Kabir Yusuf, however, said that the ruling restraining the return of Sanusi II to the throne as the Emir of Kano could not stand in view of the realities on the ground in the state.

The governor also contended that the judge who issued the order was in the United States (US).

Yusuf also vowed to report the matter to the Nigeria Governors’ Forum (NGF).

He has insisted as far as the new law dissolving the five controversial Emirates in Kano is concerned that “there is nothing stopping the recognition of Muhammadu Sanusi II as (the) Emir of Kano.”

In regard to the initial court ruling, and in defiance of the order restraining him from mounting the throne as the Emir of Kano again, Sanusi II heroically moved into the Emir’s palace Friday, and commenced his duties as the Emir of Kano.

Pronto, deposed Emir Bayero, who was out of town at the time he was deposed last week, returned to Kano last Saturday, and was escorted under heavy security to a mini palace at Nasarawa, located along the State Road in the city.

However, Governor Yusuf immediately, ordered Bayero’s arrest for “disturbing the peace”.

Subsequently, protests from Bayero’s supporters erupted across Kano Sunday, according to reports.

Like Sanusi, Bayero receives District Heads in Nasarawa palace

In a related development, Aminu Ado Bayero, deposed Emir of Kano, is reported to have received District Heads, also known as “Hakimis”, inside the Nasarawa palace, in Kano.

It was gathered Muhammadu Sanusi II, the reinstated Emir of Kano, also had earlier played host to the District Heads Sunday, May 26, in his palace.

However, the District Heads, who later paid homage to Bayero are reportedly not loyal to Emir Sanusi II.

As the situation remains tense in Kano amid the continued legal fireworks on who occupies the Kano Emir’s Palace, all eyes are on June 11 substantive hearing.

Muhammad Gumel, Commissioner of Police (CP) in Kano State, alongside other security chiefs, yet has asserted assured the citizens of enforcing the court orders.

CP Gumel reportedly said: “The order of the court restraining Sanusi as Emir will be followed to the letter.”
